01
Agreement
These terms apply when Elegant Occasions provides event management, wedding planning, styling, florals, cakes, stationery, decor hire or related services to a client. The client is the person or party named on the quote, invoice, booking confirmation or client agreement.
Website information is general only. Final availability, inclusions, pricing, delivery details and booking requirements are confirmed directly with Elegant Occasions before a booking is accepted.
02
Quotes, deposits and payments
- An initial consultation may be conducted and an estimated amount provided to the client.
- A booking is not confirmed until the required deposit is paid and accepted by Elegant Occasions.
- The standard deposit is 50% of the full amount unless another arrangement is agreed in writing.
- Deposit payments are non-refundable.
- Payments may be made in person, by credit card over the phone, or by direct deposit where those options are made available.
- An invoice will show payments made and the remaining balance. The balance is generally issued four weeks before the event or wedding.
- The outstanding balance must be paid two weeks before the event or wedding date unless otherwise agreed in writing.
Direct deposit details may be supplied on invoices or booking documents. Please confirm payment details directly with Elegant Occasions before transferring funds.
03
Event details and client information
The client must provide all information Elegant Occasions reasonably needs to plan and deliver the agreed products and services. This may include event date, time, location, venue access, delivery details, styling requirements, guest numbers and any restrictions that may affect the work.
Elegant Occasions relies on the accuracy of the information provided by the client. If information is incomplete, late or incorrect, Elegant Occasions may not be able to complete all tasks, source all items or deliver the agreed outcome.
Expenses may include products, services, booking fees, delivery costs, supplier costs and other agreed event-related costs.
04
Changes to services, date, time or location
Changes to agreed services, products, quantities, event timing or event location must be requested in writing. A change is only confirmed when accepted by Elegant Occasions in writing.
The client agrees not to change the event or wedding date, time or location without giving Elegant Occasions at least 30 days' written notice. Elegant Occasions will make reasonable efforts to accommodate a change but is not liable for costs, supplier charges, loss or unavailability caused by the change.
05
Cancellation
The client may cancel a booking at any time by written notice. If the client cancels more than 30 days before the event, any refund will exclude the non-refundable deposit, products or services already paid for, and any booking or cancellation fees incurred.
If the client cancels within 30 days of the event or wedding, all funds paid are non-refundable.
Elegant Occasions may cancel a booking if it cannot complete its duties due to fire, casualty, strike, act of God or another cause beyond its control, if the client fails to provide required information, or if payments are not made by the due dates. In those circumstances Elegant Occasions may retain funds needed to reimburse products, services and costs already paid or committed.
06
Damage, loss and hire items
The client is responsible for damage to, or loss of, products, accessories and hire items supplied by Elegant Occasions where the damage or loss is caused by the client, guests, invitees, venue staff or other people connected with the event.
Replacement or repair costs are determined by Elegant Occasions and are payable after the event. Credit card details may be held as a bond for hire items. No amount is charged unless damage occurs or items are not returned or collected as agreed. Credit card details are destroyed after items are returned or collected and any damage matter is resolved.
07
Indemnity and liability
The client agrees to defend, indemnify and hold Elegant Occasions harmless from claims, losses, damages, liabilities and costs, including legal costs, arising from the client's event, the client's instructions, venue conditions, guest conduct or activities connected with the services, except to the extent caused by Elegant Occasions' own negligence or unlawful conduct.
08
Confidentiality, conduct and governing law
Each party agrees not to publish, circulate or disclose confidential information obtained through the booking, except where permitted by the other party or required by law.
The client must comply with all applicable laws and must not engage in illegal conduct at any premises or event connected with the booking. Elegant Occasions is not responsible for unlawful conduct by the client, guests or invitees.
These terms, together with any accepted quote, invoice or written agreement, contain the full understanding between the parties and supersede prior discussions about the same booking. Any modification must be in writing and agreed by both parties. If part of these terms is found unenforceable, the remaining terms continue to apply.
These terms are governed by the laws of Victoria, Australia.
